These Terms and Conditions govern your access to and use of the services provided by COSMOS-X Technology OÜ, a company registered in Estonia (Registry Code: 17238852), located at Harju maakond, Tallinn, Lasnamäe linnaosa, Sepapaja tn 6, 15551. By creating an account or using our Service, you enter into a legally binding agreement.
You must be at least 18 years of age (or the age of majority in your jurisdiction) to use this Service.
You agree to provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your credentials and for all activities under your account.
You must notify us immediately at support@cosmosx.ai of any suspected security breach or unauthorized use.
COSMOS-X is an AI productivity workspace: AI chat and voice assistants powered by various Large Language Models (LLMs), plus tasks, notes, boards, documents, calendar, mindmaps, direct messages, automation flows, and optional third-party integrations (e.g., Telegram, Zapier). We provide the platform and infrastructure; the underlying AI models are provided by third-party vendors (e.g., OpenAI, Anthropic, Google).
We may modify features and swap or retire individual AI models as the market evolves. If we make a material change that adversely affects a paid feature you use, we will give you reasonable advance notice by email or in-app notice, and you may terminate your account and receive a refund of your unused wallet balance.
The Service uses a prepaid "Wallet" system. All transactions are processed in USD through Stripe. Applicable VAT is shown before you confirm a purchase.
The minimum top-up is $5 USD; the maximum is $500 USD per transaction.
If you are an EU consumer, you may withdraw from a wallet top-up within 14 days of purchase and receive a refund of the unused portion of that top-up. To request withdrawal, contact support@cosmosx.ai.
When you spend wallet credit on an AI request or other paid feature, you expressly request immediate performance of the Service and acknowledge that, once the credit is consumed, you lose your right of withdrawal for the consumed portion. Your express consent to this is collected when you top up, and confirmed to you on a durable medium (email receipt).
Wallet balances do not expire as long as your account remains active. If an account is inactive for more than 24 months, we may cancel the remaining balance — but only after giving you at least 30 days' notice by email, during which you can log in or request a refund of the unused balance.
If you are a consumer or business within the EU, VAT is applied to your purchase based on Estonian tax law and EU OSS (One Stop Shop) rules.
We may offer an optional referral program under which you earn commissions on purchases made by users you refer. Participation is voluntary and subject to the following:
The current commission rate is 5% of eligible wallet top-ups (excluding VAT and other taxes) made by users you referred. Where we describe the commission as "lifetime", this means the commission applies to eligible top-ups made by a referred user for as long as (a) the referral program continues to operate, (b) your account and the referred user's account remain active and in good standing, and (c) the referral attribution has not been reversed for fraud or abuse. It is not a guarantee that the program, the rate, or the Service will continue indefinitely.
A referred user who applies a valid referral code before their first wallet top-up receives a one-time bonus credit (currently 20% of that first top-up). The bonus is wallet credit, not cash: it is non-withdrawable, non-refundable, and is forfeited if the underlying top-up is refunded or charged back or if the referral is found to be fraudulent. The bonus applies to the first top-up only and cannot be applied retroactively.
Commissions are paid out via Stripe Connect. To receive payouts you must complete Stripe's onboarding (identity and bank verification). Each commission becomes payable only after a holding period (currently 60 days) that protects against refunds and chargebacks, and payouts are made once your payable balance reaches the minimum payout threshold (currently $100 USD). We may adjust the holding period and threshold for operational or fraud-prevention reasons. You are solely responsible for any taxes on amounts you receive. Commission balances are not wallet credit, are not transferable, and accrue no interest.
Participation in the referral program does not create an employment, agency, partnership, or franchise relationship. You may not make representations or promises on our behalf, bid on our trademarks in paid advertising, or promote the Service through spam or misleading claims.
Self-referrals, fake accounts, misleading promotion, or any abuse of the program result in forfeiture of pending commissions and may lead to account termination. Commissions attributable to refunded or fraudulent purchases may be reversed.
We may modify commission rates, eligibility rules, or payout terms, or suspend or discontinue the program, at any time with reasonable notice (at least 30 days for material changes, by email or in-app notice). Changes apply prospectively: commissions already earned on top-ups completed before the change take effect are honored under the previous conditions, but no commissions accrue on top-ups made after the program is changed or discontinued. If we discontinue the program, earned commissions that reach the minimum payout threshold and pass the holding period will still be paid out; smaller residual balances will be paid out or otherwise settled at our reasonable discretion.
You agree not to use COSMOS-X to: Generate content that is illegal, defamatory, or promotes hate speech/violence. Engage in "jailbreaking" or attempts to circumvent the safety filters of the underlying LLMs. Reverse-engineer the platform or use automated scrapers to extract data. Generate "Deepfakes" or non-consensual sexual content. Represent AI-generated content as being solely human-generated for deceptive purposes. Use code-execution features for cryptocurrency mining, attacks on third-party systems, or other abusive workloads. Send spam, harassment, or abusive content to other users through direct messages, channels, or connected integrations.
COSMOS-X, its logos, UI/UX design, and proprietary code are the exclusive property of COSMOS-X Technology OÜ.
You retain all ownership rights to the prompts and data you input into the Service.
To the extent permitted by law, the Company assigns to you all its rights, title, and interest in and to the output generated by the AI based on your prompts. You are responsible for ensuring that the output does not violate third-party rights.
AI-generated outputs are probabilistic and may contain "hallucinations" (factually incorrect information).
Outputs are for informational purposes only. Do not rely on the Service for legal, medical, or financial advice.
To the extent permitted by applicable law, the Service is provided without warranties, express or implied. We do not guarantee the availability of specific LLMs or the accuracy of their responses. If you are a consumer, your statutory rights (including conformity guarantees under EU digital-content rules) remain unaffected.
To the maximum extent permitted by Estonian law, COSMOS-X Technology OÜ shall not be liable for any indirect, incidental, or consequential damages.
Our total liability for any claim arising out of these Terms shall not exceed the total amount of funds you have successfully added to your wallet in the six (6) months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits our liability for intentional wrongdoing or gross negligence, for death or personal injury, or for any other liability that cannot be excluded or limited under applicable law. Nothing in these Terms affects your statutory rights as a consumer.
You may delete your account at any time. Upon request, we will refund the unused wallet balance of top-ups eligible for withdrawal; otherwise, remaining balance is handled per Section 3.
We may suspend your account immediately, without prior notice, if you breach these Terms or if we reasonably suspect fraudulent activity. We may terminate the account if the breach or fraud is confirmed; in that case, any remaining wallet balance may be forfeited to the extent permitted by law. If we terminate your account for convenience, or discontinue the Service, we will refund your unused wallet balance.
We may update these Terms from time to time. For material changes we will notify you at least 14 days in advance by email or in-app notice. If you do not agree with the updated Terms, you may terminate your account before they take effect and receive a refund of your unused wallet balance. Continued use of the Service after the effective date constitutes acceptance.
These Terms are governed by and construed in accordance with the laws of the Republic of Estonia. If you are a consumer residing in the EU, you additionally benefit from any mandatory consumer-protection provisions of the law of your country of residence.
Any disputes shall first be settled through negotiation. If an agreement cannot be reached, the dispute shall be resolved in the Harju County Court (Tallinn, Estonia), without prejudice to mandatory consumer jurisdiction rules that may entitle you to bring or defend proceedings in the courts of your country of residence.
EU consumers may also bring disputes, free of charge, to the Estonian Consumer Disputes Committee (Tarbijavaidluste komisjon) via the Consumer Protection and Technical Regulatory Authority (TTJA), www.ttja.ee.
